Construction Law

We provide comprehensive legal services to main contractors, property developers, investors, contractors and subcontractors involved in the implementation of construction projects. We support our clients at every stage of the construction process — from project preparation and contract negotiation, through to project delivery, final acceptance of the works, project settlement and, where necessary, dispute resolution.

Carrying out a construction project requires cooperation between numerous parties, the coordination of works, the monitoring of deadlines and costs, and a clear division of responsibilities. Well-prepared documentation and properly drafted contracts help to minimise the risk of delays, additional costs, disputes regarding the scope of works and liability for defects. We therefore provide advice not only when a problem has already arisen, but also at the planning and organisation stage of the project.

The main contractor bears particular responsibility for the proper organisation of the construction process, the coordination of works and cooperation with the client, subcontractors and other parties involved in the project. We provide support in securing the main contractor’s legal and economic position, in particular by analysing the risks associated with the performance of the contract and devising solutions to respond more effectively to changes and unforeseen circumstances.

We draft, review and negotiate contract documentation, taking into account the specific nature of the project and the actual scope of the parties’ obligations. We pay particular attention to provisions that may be of significant importance to the project’s profitability and the main contractor’s liability.

We also provide support in developing consistent contract templates and procedures that can be used when working with subsequent subcontractors and suppliers. This helps to standardise the way contracts are concluded and performed, and to minimise the risk of inconsistencies between the main contract and agreements entered into at later stages of the project’s implementation.

During the course of the project, we advise on matters requiring a swift legal assessment and the taking of appropriate action. We help to document events that may affect the timeframe, cost or scope of the works, including delays, downtime, gaps in documentation, design changes, unforeseen circumstances during implementation, and the actions or omissions of other parties involved in the construction process.

We prepare legal opinions, statements of position, formal notices, objections and replies to correspondence from contractors. We also advise on the management of correspondence and construction documentation in a manner that may be relevant when subsequently pursuing claims or defending against claims made by the other party.
